Sales and cancellation policy

Object:

The purpose of this document is to establish the General Conditions of Use and the General Conditions of Sale and Returns of the online sales website canmonroig.com

Identity of the parties:

The general conditions of sale described below (hereinafter General Conditions of Sale) exclusively govern the contractual relations between all users of the Website canmonroig.com

Placing your order:

  • When registering, we require that you provide us with: a first and last name, a mobile or landline contact telephone number and an email address.
  • The means of contact we will use to send you notifications about your order will mainly be email, although we may also occasionally use the telephone.
  • The conditions of use and purchase of this website are ONLY valid for purchases made in Spain, within the Iberian Peninsula and the Balearic Islands. We do not serve the Canary Islands.
  • If we accept your order, you will receive an email confirming our acceptance, which you previously provided in your user account. This Order Confirmation will be effective from the moment it is sent. If, on the other hand, we cannot accept your Order, we will try to contact you by email or telephone.

Prices:

    • POLLENTIA TRADE SL. will send a receipt by email, which will be received together with the order confirmation email. This receipt will be issued in the name of the individual or company that placed the order, so users must ensure that they write the correct name. The product or products must be collected by the user at the store located at C/ Can Valella 22, Inca, 07300 Balearic Islands.
    • Once the purchase has been made and as quickly as possible, within 48 hours, POLLENTIA TRADE SL. will send the user an email with the order receipt containing a summary of the purchase.
  • Very occasionally the prices of the products shown on our website, canmonroig.com They may be incorrectly specified and show a price that is lower or higher than expected. When this happens, and if we have confirmed your order, we will immediately contact you in order to issue a new order confirmation with the correct price. In the event that the corresponding price is higher, you may cancel your order and we will refund any amount you have already paid.
  • There may be occasions where we are unable to supply products you have ordered, for example because the products are no longer in production or are no longer available. In such cases we will contact you to let you know and may suggest alternative products you may wish to purchase. If you do not accept our suggestions we will cancel your order in respect of any products we are unable to supply and refund any money you have paid us for such products.

The return of these sums of money will be the limit of our liability to the user, if it were impossible for us to supply the products.

  • We reserve the right to modify our prices at any time. However, we undertake to apply the rates in force indicated on the website at the time of placing your order.
  • VAT at the applicable rate indicated on your invoice will be your responsibility.
  • The price of the products includes the corresponding VAT and will be the one indicated in the total amount to be paid for your order.

Availability:

  • The availability of the products offered by POLLENTIA TRADE SL. through its website may vary depending on user demand. Although POLLENTIA TRADE SL updates its stock periodically, the product requested by the user may be out of stock at that time. In such case, POLLENTIA TRADE SL. will send an email to the user informing them of the impossibility of fulfilling the order.

Supplying your order:

  • The order reception schedule is twenty-four (24) hours, three hundred and sixty-five (365) days a year, although orders placed after forty-eight (48) hours will not be processed, and will be processed on the following business day in the city of Inca. Orders received on Fridays after 2:00 p.m. and/or during the weekend will be processed first thing on the following Monday, or first business day.

The time between placing the order, its preparation, validation, verification of its data, and collection in store will be a minimum of 48 hours.

Your order must be collected on the day you indicated when making the purchase in the online store.

 Payment for your order(s):

All payments will be made in euros.
A) Payment with Paypal:

  • A) Payment by bank transfer: If you choose this payment method, the order will not be processed until we have confirmed that the funds have reached our bank account. To speed up this payment method, we recommend that you send us a copy of the transfer to canmonroig@gmail.com.
  • B) Payment by Paypal: If you choose to pay by card, your order cannot be taken into account and will not be processed until payment has been authorised by your bank or savings bank. Online payment by credit card is made through the “Secure Socket Layer” security system, which encrypts your bank details when they are transmitted over the internet.

For security reasons, POLLENTIA TRADE SL. verifies all orders paid by bank card.

The data provided will not be used under any circumstances for any purpose other than those specifically mentioned here. Under no circumstances will they be transferred to third parties and may only be used by POLLENTIA TRADE SL and only to make the purchases you request. Our secure server guarantees the privacy of the data you transmit to us. This privacy is achieved through the SSL protocol, encrypting the data sent using the RSA encryption system, when it is located in a secure area of a browser. Your browser, collaborating with the secure server, encrypts the data so that if another person, in the transmission process, manages to appropriate it, they will not be able to read it since they do not have the necessary key. You can check that your browser is secure if the security features appear, such as a key or a padlock.

Under no circumstances will the company retain your card details.

DELIVERY POLICY

Picking up your order:

  • If you are in Mallorca, the order can be picked up at the store located at C/ Can Valella 22, 07300 Inca, during our business hours (appointment required).
  • For shipments outside Inca, we have a SEUR carrier, whose shipping costs will be calculated according to the weight and place of delivery.

    Once the item has been collected by the transport agency, we will send the buyer an email indicating the tracking number.

    Returns: 
    The return period is 10 business days from the date of receipt.
    In this case you must send an email to canmonroig@gmail.com with the subject “return”
    indicating the reason for the return.
    Return shipping costs are the responsibility of the buyer.

    Refunds
    Refunds will be made in the same way that payment was initially made.

Defective item:

  • When collecting the order from our studio, you must make an appointment in advance to avoid unnecessary travel. Our staff will verify, together with the user/person who physically collects the order from the store, that the condition in which the product is delivered is optimal, correct and in accordance with what is indicated in the email confirming the order placed.

Request cancellations:

  • The user may cancel his/her order within a maximum of 24 hours from the date and time of receipt of the order, by sending an email to pedidos@fornsantfrancesc.com, indicating his/her order number.

For example, if you have placed an order to be picked up in store on the 15th at 12:00, your order can only be cancelled if you send us an email on the 14th before 12:00.

  • If you cancel your order within the established period, you have two options:
  • Or, change the pick-up day.
  • Modify the order units.
  • Or request a refund of the amount paid, which will be made either to the bank card used to make the purchase or via transfer, but never in cash. The administration department will contact you to request your details and manage the operation.

Orders not collected:

  • If the user does not pick up their order, the order will be available on the same day during store business hours.
  • If the user does not pick up their order on the specified day, the cancellation policy applies.

Changes to the order:

The user can modify his order within a maximum of 24 hours from the date and time of receipt of the order, by sending an email to canmonroig@gmail.com, indicating his order number.

As long as the modified varieties and units are available.

  • POLLENTIA TRADE SL. reserves the right to modify the commercial offer presented on the website fornsantfrancesc.com (modification of products, prices, promotions and other commercial and service conditions) at any time.
  • POLLENTIA TRADE SL makes every reasonable effort to ensure that the information displayed on its website is accurate and free of typographical errors. If any such error occurs, which is at all times beyond the control of POLLENTIA TRADE SL, it will be corrected immediately as soon as it is detected. If the error occurs in any of the prices displayed and a user has made a purchase, we will inform the user of the error and the user will have the right to cancel their order at no cost to them. The sending of an automatic purchase confirmation does not validate the conditions of an erroneous price.
  • The information presented on this website is in Castilian (Spanish language), including the formalization of the contract and all contractual information shown and sent to consumers or users.

Force Majeure:

We will use our best endeavours to fulfil our obligations arising from your order. However, we will not be liable for delay or failure to perform if the delay or failure is due to force majeure. In the event of delay, we will fulfil our obligations as soon as reasonably possible.

Applicable legislation and competent jurisdiction:

The interpretation and execution of the conditions, as well as all acts that are a consequence of them, will be subject to the Spanish law, unless there are public order provisions contrary to this.

Nullity and Ineffectiveness of the Clauses:

If any clause included in these General Conditions as of July 2023 were declared, totally or partially, null or ineffective, such nullity or ineffectiveness will affect only said provision or the part thereof that is null or ineffective, the General Conditions remaining in force in all other respects, such provision, or the part thereof that is affected, being considered as not included.
